These Terms and Conditions govern the use of the Heritex platform (the “Service”) by users.
1. Provider

Heritex is a product of a sole proprietorship (small business).
2. Scope of the Service
Heritex is a web‑based application for AI‑assisted analysis of art, antiques, and collectibles based on user‑provided images and information.
The Service does not provide binding appraisals, expert reports, or legally binding valuations.
3. Service description
(1) Users can upload image material and request analysis services.
(2) The analysis is automated using artificial intelligence and optionally external information sources.
(3) Results are provided in structured form (e.g., text reports, presentations, exports).
(4) There is no entitlement to a specific depth, accuracy, or completeness of the analysis.
4. Registration and user account
(1) Use of the Service requires a user account.
(2) Users must provide truthful information during registration.
(3) Login credentials must be kept confidential and not shared with third parties.
(4) The provider reserves the right to suspend or delete accounts in case of violations of these Terms.
5. Credit system
5.1 General
(1) Use of analysis services is credit‑based.
(2) Credits can be obtained via free allowances or through paid credit packs or subscriptions.
5.2 Consumption of credits
(1) Credits are consumed when an analysis starts.
(2) Consumption occurs regardless of whether the user later retrieves or exports the result.
(3) Consumed credits are non‑refundable, even if results are subjectively unsatisfactory.
6. Prices and payment
(1) Current prices are shown on the Service’s pricing page.
(2) Payments are processed through external payment providers.
(3) As a small business under § 19 UStG, no VAT is charged or shown.
7. No right of withdrawal for digital services
There is no right of withdrawal, as this is digital content provided at the user’s express request and execution begins with the consumption of credits (§ 356(5) BGB).
8. User obligations
The user undertakes in particular to:
- upload only content for which they hold the necessary rights
- not provide illegal, abusive, or offensive content
- not use the Service for automated mass access or abuse
9. Disclaimer for analysis results
(1) The provided analysis results are not binding valuations, expert reports, or market prices.
(2) They are for non‑binding orientation only.
(3) Decisions based on the results (e.g., purchase, sale, insurance) are made solely at the user’s own risk.
10. Liability
(1) The provider is liable without limitation for intent and gross negligence.
(2) For slight negligence, liability applies only to essential contractual obligations and is limited to foreseeable damages.
(3) Liability for lost profits, indirect damages, or consequential damages is excluded to the extent permitted by law.
11. Service availability
(1) There is no entitlement to permanent availability.
(2) Maintenance, technical issues, or external dependencies (e.g., AI services) may lead to temporary limitations.
(3) This does not entitle users to a refund of credits.
12. Term and termination
(1) Free user accounts can be cancelled at any time.
(2) Subscriptions can be terminated according to their stated conditions.
(3) The right to extraordinary termination remains unaffected.
13. Changes to the Service
The provider may adjust or further develop functions, analysis models, or the scope of the Service, provided essential contractual obligations are not materially impaired.
14. Data protection
Personal data is processed in accordance with the Privacy Policy, available at /datenschutz.
15. Final provisions
(1) The law of the Federal Republic of Germany applies.
(2) Place of jurisdiction is – insofar as permissible – the provider’s seat.
(3) Should individual provisions of these Terms be invalid, the validity of the remaining provisions remains unaffected.
